Constitutional Abuse Raises Ire of The American Legion

Washington (July 8, 2009) - "Tipping the scales of justice - even a little bit -- is wrong," says the leader of the nation's largest veterans' service organization as he reacted to the latest legal actions on behalf of the Westboro Baptist Church. The Kansas-based church's founder, Fred Phelps, and his followers proclaim that the United States is being punished for its lax attitude toward homosexuality by the deaths of American soldiers. This has led to the church group protesting at the funerals of and memorial services for slain warriors. They carry such placards as, "Thank God For Dead Soldiers."

"It is clearly their constitutional right to challenge any law that infringes on First Amendment rights, but what about the First Amendment rights of our fallen heroes, their families and friends?," asked David K. Rehbein, national commander of The American Legion. "I want everyone to know that The American Legion will continue to fight for the rights of those who paid the ultimate sacrifice as well as their survivors and friends as they pay their final respects."

It is now being reported that a Maplewood, Mo., statute restricting such demonstrations as staged by Phelps and followers during and after private funerals is being challenged by the American Civil Liberties Union (ACLU) on the basis of being overly broad and a violation of the First Amendment.

"Regardless of the ultimate legal ruling," said Rehbein, who recently returned from Iraq, "it will not absolve Phelps and his group for uttering what I consider to be the very definition of hate speech. It is our hope that the president, Congress, the Supreme Court and state legislatures - working together -- will find a way to limit such despicable behavior; that someday human decency will prevail and this type of misconduct will be banished forever.

"Once the ACLU finishes attempting to defend the rights of Phelps, I hope it will join with The American Legion and the vast majority of Americans who believe the privacy rights of fallen heroes, their families and friends should be protected and preserved as they are allowed to mourn and grieve without wanton harassment," concluded Rehbein.

With 2.6 million members, The American Legion is the nation's largest veterans service organization. The Legion traditionally works hand-in-hand with members of Congress, leadership of the Department of Veterans Affairs and other key stakeholders to assure appropriate funding and policy making on measures and issues affecting the military's active duty, National Guard and Reserve personnel, veterans, and their families.

Absolutely right, Commander, that is what Phelps and his group do. They have the right to say what they please, but must not intrude on the privacy of grieving families as their fallen loved ones are laid to rest.

If a vote is held to allow a country's military to attack and occupy a country that did not attack it and 99% of the people vote to support such an attack can we say that such voters are citizens of a (democratic) republic or would a more true statement be that these voters are criminals in a continuing criminal enterprise. i was at a service for a fallen MARINE in a small town. this group showed up and told the local l.o.e. that he couldnt stop them from rasing h###. he looked them in the eye and said " nope thats your right but rember theres an old saying" your freedom of speach ends where a fist starts. he then turned and walked away saying to a fellow officer did or will you see anything. "nope." the group left town as fast as they could.

People & groups have rights but the rights of one are weighted against another. Phelps & his church may have free speech rights but accoutibility for actions are viewed when exercise of those rights violate the right of others; in the interest of the public, another person or group (families, etc). It can result in a criminal act and/or civil penalities! In this case the right of family privacy @ military funeral should greatly outweight free speech right of Phelps & church! Not absolute!

According to this article, the ACLU is once more going to do battle in court on my tax dollar. I don't see where I owe them a dime to protect Phelps or any other nutcase. The ACLU seems to have its hand in my pocket and I can't get it out. This has to stop!

I don't think his intention is to "attend". It's more like "crash". As a member of the Patriot Guard Riders, I have not yet seen any of Phelps' scum at the funerals of our fallen heros here in the Spokane WA area, but I have stood in the flag lines just the same, ready to shield the families of those hero's from his hate. I have seen the news footage of his followers and their demonstrations. It is nauseating to see little kids that consumed by hate,and not have a clue what they are hating.

Given half a chance to fight side by side, Mr. Phelps would have a new found respect for another warrior....especially if he saved his life. I guess certain preferances would suddenly no longer matter!

With a website entitled http://www.godhatesfags.com/ speaks volumes about Phelps and his congregation at Westboro Baptist Church. One visit is sickening enough to never return. Sadly, there are pictures of young children being exposed to his distorted views and opinions. How he can justify his actions with scriptures is extremely troubling. Whatever he is selling, thank goodness the vast majority of people don't want.
The rights they don't fall for

There is a right to free speech. This right they exercise so viciously is something few of them have faught for. I can make this assertion simply because if they faught for it they would respect the others charged to do the same. These wackos confuse our roles as defenders to those of a politician. I suppose the best way to react to this outrage would be to do the same at any of thier childrens funerals. I am sure they would understand the disrespect very quickly. HUA! Just Respect the troops!
Returning Heros

I think it is a travisty that a group of of left wing, bleeding liberals, and the media, worked so hard to be allowed to photograph the returning heros coffins, and in some cases families. As usual they have pushed freedom of speech way beyond the ammendments basic concept. Give the families the dignity of mourning.

I don't like what Mr. Phelps says or how and where he says it but I served my country so that sane folks as well as nutcases could have the right to free speech.If we start censoring speech how long will it be before we can't have these discussions or go to the church on Sunday to hear the Word of God preached.Maybe we should outlaw the ACLU instead.

Religion should be practiced in the privacy of your home or place of worship If any one of the hundreds of faiths can prove their is a god and not just Holy books that were all written by men to control people and if prayer can stop all inhumanity to man than I will believe that these books are true. Until than they are lies and stories made up by man. I will not give my name some bible thumping fool will try to assasinate a non- beliver in the name of an all merciful and forgiving god.

Look up the story of the 4 chaplins whom prayed for the safety of the soldiers & sailors sinking in the Alantic Ocean. They scraficed their lives to ensure that those military persons left the ship safely! Don't curse God for Phelps & his congregation actions! Military personnel have often sought God's help in desprate time on need! Chaplins daily prayers have often brought courage thru faith to those in battle & God's anwser to return them safely! God stands on the right of might > pray!

I respect your right to your opinion even if you are wrong.If you have been the places i have and survived the close calls when you should be dead the only thing that makes sense is God answering prayer and bringing us back home.My unit had a lot of wounded while in Iraq but we all came home alive due to God's protection.

There is no need to make any laws that prevent such by Phelps & his church! The U.S. Const. under the 1st, 4th,9th Amend. protect the right of privacy of individuals & groups (families); therefore Phelps & his followers should be arrested for a federal criminal act of constitutional violations of right of privacy of that deceased veteran's, KIA, retired, or other death status military person's family! The right of family privacy & respect should outweight any other! GWW

As a veteran and a son a father of that 2nd Great War; I wish to remind you of the famous prayers given up to God for desprate help for that of only which God can do! Hiesenhower delay the D-Day invasion to a point, but he prayed hard for a clam sea which god gave on June 06'44. Patton prayed for the rain to stop so his equipment could move forward; God granted! Your comments are just as scarey as Pheleps & his church! I doubt from your statements your old enough to remember! When I was a child, they took the right of prayer & pledge of allegience away from me! Some women in a case in the U.S. Supreme Ct., said she didn't believe! God is not the problem, but persons like Pheleps and his church, that support descretion of a military funeral by their protests. God will hold such persons accountible! Unfortunitly those church members are lead by a false self proclaimed profiet. It's sad but some Pastors are not worthy of their flock and God has not ordained them to act as they do! Look on the back of your dollar bill (In God We Trust), look in our National Constitution at it's beginning; the Preamble and the forefathers discussion as to why they rebeled from England! I would like to remind you that the American Legion from it's beginnings has proclaimed to put God first. You need to attend your Post meetings to find that out when the Post Chaplin gives prayer for our country, comrades, POW/MIA'S and those that died and never come home. God is in our Flag and Country; as a triditional stance of the nearly 100 year history of the AML. You don't attends your Post meetings or you would know that! It's privacy issue, not speech!

You know, maybe it's just me, but I had though that the idea behind the American Legion was to be a patriotic, mutual-aid veterans organization, one inclusive for *all* veterans, regardless of whom we may or may not worship. As for the Pledge of Allegiance and the national motto, that dates to the early 1950s and the Red Scare. I rather miss the original national motto: E Pluribus Unum, which was far more inclusive than the current motto.
